Terms & Conditions
Technical Standards, Warranty & Limitation of Liability — Sintered Stone Clients.
These Terms & Conditions are established to ensure a smooth, transparent, and professional collaboration between the Client and K3I (“the Contractor”). K3I is committed to delivering high-quality workmanship, responsible coordination, and professional after-service, while recognizing that installation services are executed by skilled human labor within active construction environments.
1. Pattern Classification, Vein Logic & Visual Expectation
- Materials specified as random patterns shall be installed randomly without preference for specific vein orientation.
- No claims for replacement, dismantling, compensation, or price adjustment shall arise from aesthetic preference.
- For bookmatch, endmatch, or endmatch loop patterns, absolute vein continuity is not guaranteed. An alignment tolerance of ±1.5 cm is deemed acceptable.
- All drawings, renderings, and illustrations are conceptual references only.
- Any slab dry-lay or vein preview is provided solely as a complimentary service for client satisfaction and does not constitute a guarantee.
2. Brand-Specific Breakage & Cutting Warranty (Dekton, Quadra & Titanium only)
- A workmanship warranty for breakage (CRACKS) or cutting errors during installation applies exclusively to Dekton, Quadra, and Titanium.
- If no pre-ordered waste slab is available, replacement shall be provided using the same model subject to stock availability, or similar model if not available.
- Minor tone or shade variation may occur and shall be accepted.
- This warranty does not apply to other brands.
3. Workmanship Warranty – Epoxy Resin (3 Months)
- A three (3) month workmanship warranty applies solely to epoxy resin related works, covering detachment, shrinkage, or failure under normal usage.
- Damage caused by impact, abuse, excessive load, or third-party interference is excluded.
4. Nature of Work & Human Craftsmanship
- All works are executed by human labor in accordance with industry standards.
- Absolute dimensional perfection is technically unachievable, as even factory-produced materials carry manufacturing tolerances.
- Reasonable technical tolerances are inherent and shall not be deemed defects.
5. Workmanship Tolerances & Repair Method
- Alignment and level deviation tolerance for all sintered stone installations, including junctions between sintered stone and other materials, shall be ±2 mm.
- Industry-standard grout or joint width commonly ranges from 1.5 mm and above using tile spacer & tile leveler.
- Minor edge chipping up to ±1.5 cm shall be resolved through epoxy resin repair with closely matching color and shall be deemed acceptable.
- Hollow sound on solid substrates (concrete, plaster, screed) is acceptable up to 15% per dimension of slab installed.
- If screed or plaster is performed by others, hollow sound warranty does not apply.
6. Hollow Sound on Non-Solid Substrate (Dry System)
- For installations on non-solid or dry system substrates, including steel framing, metal structures, plywood, HMR board, PVC board, or similar systems, a hollow sound is a natural and unavoidable condition.
- Such hollow sound does not indicate improper installation or reduced performance.
- No hollow sound warranty applies to non-solid substrates, and no claims for dismantling, replacement, or compensation shall arise.
7. Material Characteristics & Non-K3I Supplied Materials
- Natural variation in tone, shade, texture, and pattern is inherent to sintered stone and ceramic materials.
- For materials not supplied by K3I, tone inconsistency or visual variation shall not constitute workmanship defects.
8. Matte Surface – Extraordinary & Rare Conditions
- Certain matte surfaces may develop irreversible staining despite correct installation.
- Such conditions are classified as material behavior, not workmanship defects.
- At the Owner’s request, a complimentary subsidy of reinstallation labor may be offered, excluding material and treatment costs.
9. Kitchen, Furniture & Level Measurement Clarification
- Installation relies on underlying cabinetry and structure flatness.
- Sealant thickness typically ranges between 1.0–1.5 mm and does not materially alter level conditions.
- Perfect zero-level flatness (0.00) measured by waterpass is technically impractical.
- Provided that level variation does not affect function or safety, such conditions shall be deemed acceptable.
10. Floor Flatness Principle
- Absolute floor flatness of 0.00 measured by waterpass is unattainable.
- Minor variation is acceptable provided functionality is not impaired.
11. Shared Work Environment & Joint Responsibility
- Construction projects involve multiple parties working concurrently.
- All parties are expected to exercise reasonable care in safeguarding finished works.
- Placing high-value finished items in active work areas without adequate protection shall be considered shared risk.
12. Surface Protection, Scratches & Third-Party Interference
- Surface protection is preventive and not an absolute guarantee.
- Damage caused by third parties is excluded from the Contractor’s responsibility.
- If damage is caused by the Contractor, repair shall be performed in accordance with standard procedures.
- Third-party caused restoration shall be treated as additional chargeable work.
13. Proof of Claim
- All claims must be supported by either dated photos or videos, written chronology, inspection access, or credible witness.
- Any witness statement shall be considered credible only if the witness was physically present at the same location and directly observed the relevant activity at the time the event occurred.
- Unsubstantiated claims shall not be considered valid.
14. Delay & Liquidated Damages
- Delays solely attributable to the Contractor shall be subject to liquidated damages of 0.1 per mille per calendar day, capped at 5% of the service contract value.
15. Complaint Handling & Acceptance
- All complaints must be submitted via the official complaint form.
- Once resolved, the work shall be deemed completed.
- Subsequent requests shall be treated as additional work.
16. Limitation of Liability, Risk Allocation & Insurance
- The Contractor’s liability applies exclusively to the service portion of the contract and excludes material value.
- Total liability is limited to a maximum of 10% of the service contract value or the value of services within the affected area, whichever is lower.
- The Contractor is not an all-risk insurer of the project.
- Clients requiring coverage beyond this limitation are advised to arrange project insurance (CAR insurance – Contractor’s All Risk insurance).
17. Single Point of Communication, Schedule Control & Warranty Validity
- K3I adopts a single-point-of-communication policy to ensure clarity, accountability, and effective project coordination.
- All project-related instructions, approvals, changes, site arrangements, scheduling confirmations, and commitments shall be communicated exclusively through the officially appointed Project PIC, as stated in the applicable Work Confirmation / SPK.
- Any error, defect, damage, delay, or schedule deviation arising from instructions, directions, appointments, or commitments conveyed to parties other than the designated Project PIC shall be deemed outside the Contractor’s responsibility.
- Under such circumstances: any resulting delay shall not be classified as Contractor-caused delay, and no delay penalties, claims, or compensation shall apply, and the workmanship warranty as stipulated in Clause No. 2 of these Terms & Conditions shall be deemed invalid and not applicable.
- Project schedules and timelines are considered valid only when coordinated and confirmed through the appointed Project PIC.
- Any change to the appointed Project PIC shall only be valid if communicated in written form, through commonly used communication media such as WhatsApp, email, or other written records, and acknowledged by K3I.
- This policy is established to prevent miscommunication, protect all parties, and ensure orderly project execution.
18. Acceptance
- By making payment, issuing instructions, or allowing work execution, the client is deemed to have read, understood, and accepted these Terms & Conditions.
